ORDER:
Heard learned Counsel for the petitioner, learned Government Pleader for Respondents 1 to 3 and learned Counsel for Respondent No.4.
This Writ Petition was filed challenging Memo No.9849/M- 1(1)/2007, dated 8.1.2008, under which the mining plan submitted by the fourth for an extent of 69.474 hectares in Sy.No.969/A of Hattibelegal village, Aluru Mandal, Kurnool District which was approved by the Director of Mines and Geology, Hyderabad was called for for approval of the mining lease application. It is represented by the learned Counsel for the petitioner that subsequently the Government issued G.O.Ms.No.154, Industries and Commerce Department, dated 24.06.2008 and challenging the same, the petitioner filed Writ Petition No. 18892 of 2008 and the same is pending adjudication.
In view of the same, nothing survives for consideration in the present Writ Petition. It is open to the respondents to raise all the contentions including the contention of suppression of material facts, if any, by the fourth respondent in the subsequent Writ Petition.
In view of the subsequent developments after filing the present Writ Petition, no further orders need be passed herein.
Accordingly the Writ Petition is dismissed as having become infructuous. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
