THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 23461 of 2004 ORDER: (Per the Hon’ble Sri Justice Sanjay Kumar) This writ petition was filed in the year 2004 laying a challenge to Rules 16 to 24 of the A.P. (T.A.) Land Revenue Rules, 1951. The grievance of the petitioner in this regard related to the impugned notice dated 02.12.2004 issued by the Mandal Revenue Officer, Ramannapet Mandal, Nalgonda District.
This Court, while ordering notice before admission on 20.12.2004, directed status quo obtaining as on that date to be maintained by the parties.
Sri Vedula Venkataramana, learned senior counsel appearing for the petitioner, states that owing to the status quo order no further action was taken by the respondent authorities in the matter. He further states that his client may be permitted to raise his objections to the notice dated 02.12.2004 at this stage and that liberty may be given to him to approach this Court again in the event an adverse order is passed thereafter.
We find this to be a reasonable request and dispose of the writ petition permitting the petitioner to raise his objections to the impugned notice dated 02.12.2004 within four weeks from today. In the event an adverse order is passed by the authority concerned upon examination of the objections submitted by the petitioner, he shall be at liberty to assail the same in accordance with law. Liberty is also given to the petitioner to lay a challenge afresh to the statutory Rules, if so advised. Interim order dated 20.12.2004 shall stand vacated.
In the light of this final order, pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
