RESPONDENTS ORDER:
This writ petition, filed under Article 226 of the Constitution of India, challenges non-consideration of the cases of the petitioners for grant of pension under Swatantra Sainik Samman Pension Scheme, 1980, despite the recommendations of the State Government.
2. Heard Sri K. Ananda Rao, learned counsel for the petitioners and Sri P. Vishnuvardhan Reddy, learned Solicitor General for the 1st respondent-Union of India.
3. When the matter is taken up today for hearing, the learned counsel for the petitioner has brought to the notice of this Court that the 1st respondent-Union of India filed a counter stating that the Union of India passed speaking orders dated 31.03.2006, 8.09.2006, 8.09.2006 and 31.03.2006, rejecting the claim of the petitioners.
4. The learned counsel for the petitioner has requested to grant permission to the petitioners to question the said orders of rejection passed by the 1st respondent. It is also submitted by the learned counsel for the petitioner that the said rejection orders dated 31.03.2006, 8.09.2006, 8.09.2006 and 31.03.2006 have not been communicated to the petitioners. This Court considers the said request as reasonable one.
5. In the circumstances, the writ petition is closed, directing the respondents to serve the above rejection orders to the petitioners within a period of two months from the date of receipt of a copy of this order, and liberty is also given to the petitioners to assail the said orders, if they choose to do so. No order as to costs. As a sequel, miscellaneous petitions, if any, also stand closed.
