JUDGMENT / ORDER

ORDER:
This is a case of a student, who is stated to have suffered from Chikungunia Fever as well as kidney stones, and there was a shortage of minimum attendance. Petitioner seeks that he be permitted to pay examination fee for the third semester for Diploma in Civil Engineering. Admittedly, the shortage of attendance is much more than the permissible limit, which cannot be condoned.
In the absence of any regulation or power, the authorities, therefore, could not have permitted the petitioner to appear for the exam and, as such, the action of the respondents in not receiving the examination fee from the petitioner cannot be said to be arbitrary and illegal. No relief, therefore, can be granted to the petitioner even assuming that his reason for absence is genuine.
Writ petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
