HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.7008 of 2014 Order:
The petitioner seeks for quashment of C.C.No.4 of 2012 on the file of the Additional Judicial Magistrate of First Class, Anantapur. He allegedly committed the offences under Sections 420, 468 and 471 read with Section 34 IPC and under Section 156(3) Cr.P.C., which are triable under warrant procedure.
2. I, therefore, consider that it would be appropriate for the petitioner to approach the Trial Court and seek his discharge. As an alternative remedy is available to the petitioner, I am not inclined to consider the application on merits under Section 482 Cr.P.C.
3. Consequently, this criminal petition is disposed of granting liberty to the petitioner to move the Trial Court for discharge. The miscellaneous petitions, if any, pending in this petition shall stand closed.
