JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 18.01.2017 CORAM THE HONOURABLE MR. JUSTICE R.MAHADEVAN Crl.O.P.No.952 of 2017 Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondent to complete the investigation in Crime No.251 of 2016 on the file of the respondent and file final report within the time frame fixed by this Court.

Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent to complete the investigation in Crime No.251 of 2016 pending on his file and file final report within a time frame fixed by this Court.
2. It is the case of the petitioner that as against one Mariyayee, the tenant and others, she lodged a complaint with the respondent and on receipt of the complaint, the respondent police conducted enquiry and during enquiry, the said Mariyayee gave an undertaking before the respondent police to vacate the house on or before 18.1.2016 and undertook that she would not give any trouble to the petitioner. However, even thereafter, the said Mariyayee and others trespassed into the petitioner's property. Hence, the petitioner lodged a complaint with the respondent police, but, no action was taken. Therefore, she filed a petition in Crl.O.P.No.6110 of 2016 before this Court and as per the direction of this Court, a case was registered in Crime No.251 of 2016. Thereafter, no action was taken on the said complaint. Hence, the present petition.
3. I have heard the learned Additional Public Prosecutor.
4. Considering the facts and circumstances of the case, this Court directs the respondent to investigate the case in Crime No.251 of 2016 pending on his file and file a final report, as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order. The Criminal Original Petition is ordered accordingly.
