JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE TENTH DAY OF OCTOBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29398 of 2014 BETWEEN K.Mallikarjuna AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. This writ petition is filed alleging that though the F.I.R. was registered viz., F.I.R.No.19 of 2014, before the Guntakal Police Station, no investigation has so far taken up in spite of lapse of more than nine months.
3. Learned Government Pleader for Home has received instructions from the Station House Officer, Guntakal Rural Police Station, which states that on receiving the complaint, the police have registered a case in Crime No.19 of 2014 and a copy of the F.I.R. is also enclosed. It is further stated that during the course of investigation, 15 witnesses were examined, but however none of the witnesses have supported the petitioner’s version and have denied occurrence of any such incident as occurred. The investigation reveals that there was a civil and family dispute between the petitioner and his brothers relating to survey No.508-B to the extent of Ac.5-47 cents in Pulaguttapalli of Guntakal Mandal. A civil suit was already filed by the petitioner before the Senior Civil Judge, Gooty and a temporary injunction was already obtained.
4. Since the investigation was already completed, as is evident from the instructions above, nothing further survives except directing the Station House Officer, respondent No.4 herein, to complete the investigation, if any left, and then file the final report before the court in accordance with law.
With the above direction, the writ petition is disposed of.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
