ORDER:
This petition is filed to withdraw divorce O.P.No.31 of 2014 from Senior Civil Judge, Narayanpet, Mahabubnagar District and transfer the same to Family Court, Mahabubnagar.
Wife is the petitioner. She filed her affidavit in support of the petition. According to which, their marriage was performed on 05.05.2001 at Makthal village, Mahabubnagar District. After 2011, due to harassment from her in-laws side, she left the marital home and living with her father and brother. Her husband filed divorce OP before the Senior Civil Judge, Narayanpet and it is far away from her place of residence and she is depending on her parents. Her father is barber and he is getting very meager income and as such she cannot meet the travel expenses from her place of residence to Narayanpet. She has also no male assistance to escort her from place of residence to Narayanpet and for these reasons, she sought transfer of divorce OP filed by her husband from Senior Civil Judge, Narayanpet to Family Court, Mahabubnagar.
Respondent, in spite of service of notice, neither appeared in person nor through any Advocate.
Heard the arguments.
Considering the reasons stated in the affidavit and also considering the convenience of the wife, O.P.No.31/2014 is withdrawn from the Senior Civil Judge, Narayanpet, Mahabubnagar District and transferred to Family Court, Mahabubnagar for disposal in accordance with law.
Accordingly, the Transfer Miscellaneous Petition is allowed.
No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
