DIRECT THE R-2 TO CONSIDER THE REPRESENTATION DATED: 01.08.2012 OF THE PETITIONER AS AT ANNEXURE-E AND TO MAKE THE PAYMENT OF LEAVE ENCASHMENT BENEFIT AS PER THE RULES, ALONG WITH INTEREST THEREOF AND ETC.
THIS PETITION IS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Petitioner has sought for following Prayer:
(i) call for the records from the respondents:
(ii) issue writ of mandamus or any other order or direction, directing the second respondent to consider the representation dated 01.08.2012 of the petitioner as at Annexure-E and to make the payment of leave encashment benefit as per the rules, along with interest thereof;
(iii) issue writ of mandamus or any other order or direction directing the fourth respondent to make payment of traveling allowances of Rs.24,000.00, leave fare concessions (L.F.C) of Rs.1,00,880.00 and leave encashment under L.F.C. of Rs.57,204.00 along with interest thereof to the petitioner, which are all pending for payment as per the bills in the office of the fourth respondent;
(iv) to grant such other relief’s as this Court deems fit; in the interest of justice and equity.
2. Petitioner’s grievance is relating to extending service benefits like leave encashment along with interest and traveling allowances etc., Concerned respondent has not taken any action either accepting the petitioner’s grievance or rejecting. Therefore, concerned respondent is hereby directed to take a decision and pass a speaking order on the petitioner’s grievance within a period of eight weeks from the date of receipt of this order and communicate the decision to the petitioner.
3. With the above observation, writ petition stands disposed off.
