THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY CIVIL REVISION PETITION No. 2949 OF 2011 ORDER:
The respondent filed R.C No. 48 of 2006 against the petitioner for eviction from the petition schedule properties before IV Additional Rent Controller, Hyderabad. Grounds of wilful default in payment of rent and denial of title were pleaded. The petitioner opposed the R.C by filing counter.
In the course of recording of evidence, the petitioner intended to file two documents, namely, the certified copy of the order in R.C No. 47 of 2006 passed by the Principal Rent Controller, Hyderabad and the certified copy of the order in R.A No. 22 of 2006 passed by the Additional Chief Judge, City Small Causes Court, Hyderabad. The learned Rent Controller passed docket order dated 28- 09-2010 refusing to receive the said documents. Hence this revision.
Heard the learned counsel for the petitioner and the learned counsel for the respondent.
The documents that are sought to be filed by the petitioner are the certified copies of the orders in R.C and R.A. In case, the proceedings are between the same parties, they can certainly be received in evidence. Further, no question of general importance was decided therein. The question involved in the R.C was the one of default in payment of rent. Such questions are decided purely on the basis of the evidence before the learned Rent Controller. The petitioner is not able to convince the Court about the relevance of the documents in the present case.
Hence, the C.R.P is dismissed. The miscellaneous petitions filed in this revision shall also stand disposed of. There shall be no order as to costs.
