Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondents not to harass the petitioner and his family members under the guise of enquiry in pursuance of the civil dispute without following due process of law.
2. It is the case of the petitioner that there is a civil dispute between the petitioner and his father as well as brothers and in this regard, a civil case in O.S.No.222 of 2016 is also pending before the District Munsif Court, Dharapuram. While so, based on the false complaint given by his brother, the respondents 2 and 3 are threatening the petitioner and often come to his house even at midnight and are torturing him and his family members. Hence, the present petition.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, on instructions, submitted that the respondents are not harassing the petitioner as alleged by him and in fact, the respondents require the cooperation of the petitioner as well as the de facto complainant to conduct enquiry on the complaint given by the brother of the petitioner.
4. The said submission made by the learned Additional Public Prosecutor is hereby recorded. The petitioner is directed to cooperate with the respondent police to have the enquiry completed. The criminal original petition is disposed of accordingly.
