JUDGMENT / ORDER

HONOURABLE SRI JUSTICE S.RAVI KUMAR CRIMINAL PETITION No.2658 OF 2012 ORDER:
This petition is filed to quash C.C.No.646 of 2010 on the file of IV Additional First Class Magistrate, Warangal, registered for the offences under Sections 498 (A) I.P.C. and Sections 3 and 4 of Dowry Prohibition Act .
2. Heard advocate for petitioners and learned Public Prosecutor.
3. Petitioners herein are A.2 to A.5 in the above referred C.C.
4. Learned counsel for the petitioners submitted that A.2 is mother-in-law, A.3 is father-in-law, A.4 is sister and A.5 is brother-in-law of A.1 and all the petitioners are implicated along with husband without any material.
5. As seen from the material, cognizance was taken in the year 2010. According to submission of counsel for petitioners, the case is still pending in the trial court and both parties are attending the court. He submitted that 4th petitioner would be in abroad most of the time and because of this case, he is facing lot of inconvenience and without any material he is implicated.
6. Considering the facts of the case, nature of offences and the relationship of petitioners with the de facto complainant, I feel that instead of deciding the matter on merits, by dispensing with the presence of petitioners before the trial court for each and every adjournment and directing the trial court to expedite the trial, would meet the ends of justice.
7. For these reasons, this Criminal Petition is disposed of giving liberty to the petitioners to urge all these grounds before the trial court, during trial and by dispensing with the presence of the petitioners before the trial court for each and every adjournment, but, however, they shall appear as and when directed by the trial court when it feels their presence is necessary.
8. With this observation, this Criminal Petition is disposed of.
9. As a sequel to the disposal of this Criminal petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
