The grievance of petitioner in the writ petition is that 4th respondent erected a kiosk in front of his house without obtaining permission from respondent nos.1 to 3 and although 3rd respondent issued a notice on 04.02.2010 asking the 4th respondent to remove the said kiosk, the 4th respondent had not done so and the 3rd respondent is also not doing anything to remove the said kiosk.
2. No counter-affidavit is filed by any of the respondents even though the writ petition was filed as long back as in January, 2012. Therefore, it is treated that the respondents have no response to the writ petition.
3. Since there is nothing to show that 4th respondent was permitted to put the kiosk in front of petitioner’s house by respondent no.3, the very erection of the said kiosk cannot be countenanced. The 3rd respondent shall ensure that the said kiosk is removed immediately and his own order dt.04.02.2010 is implemented.
4. The writ petition is allowed with the above direction. No order as to costs.
5. Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
