Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, III Town (L & O) Police Station, Visakhapatnam District to release the petitioner on bail in the event of the petitioner arrest in relation to Crime No. 598 of 2013 on the file of the Station House III Town (L & O) P.S., Visakhapatnam.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri G. Raj Kumar, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent- State, the Court made the following ORDER:-
“Heard both sides.
This petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners-accused Nos.1 and 4 to 8 for their release in the event of their arrest in connection with crime No.598 of 2013 of III Town (L&O) Police Station, Visakhapatanm, registered for an offence punishable under Sections 420 and 120B of Indian Penal Code.
A perusal of the complaint shows that offence pertains to the year 2000 and as regards the subject matter certain civil suits are also filed. Petitioners are said to be the permanent residents of Narsipatnam, Visakhapatnam.

Considering the above, this petition is allowed and the petitioners-A.1 and A.4 to A.8 are directed to surrender before jurisdictional Magistrate concerned and on such surrender they shall be enlarged on bail on their executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the likesum each to the satisfaction of the said Magistrate. Petitioners are further directed to co-operate with the investigation agency during enquiry, not to interfere with the investigation and appear before the investigation agency as and when required.”
