HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20637 of 2010 ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents.
2. The petitioner was appointed as Fair Price shop dealer of Gouthapur village, Tandur Mandal, Ranga Reddy district by proceedings 06.12.1995 and authorisation was renewed from time to time. Though the petitioner was married in the year 1998, she continued to stay at her father’s place i.e., Gouthapur village, Tandur Mandal. While so, a show cause notice dated 16.01.2010 was issued calling upon her to submit her explanation to the allegation that she was not residing in the said village and her marriage was performed 10 years back and her brother was running the fair price shop and thus violated the conditions of authorisation. As the health of the petitioner was not in good condition, she could not submit her explanation within time and her husband requested the 2nd respondent to extend time for submission of her explanation. Though the 2nd respondent agreed for extension of time, the impugned order was passed on 27.02.2010 on the ground that no explanation was submitted by the petitioner. Challenging the said order, the petitioner filed the present writ petition.
3. This Court by interim order dated 18.08.2010 granted suspension of the said order.
4. There is a remedy of appeal available to the petitioner and the petitioner obviously has not availed the said remedy.
5. In the circumstances, the petitioner is given liberty to avail remedy of appeal in accordance with the provisions of the A.P. State Public Distribution System (Control) Order, 2008, within a period of three months from the date of receipt of a copy of this order and the interim suspension granted by this Court on 18.08.2010 shall continue till pending of the said appeal.
6. The writ petition is accordingly disposed of. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
