JUDGMENT / ORDER

Prayer:- Civil Revision Petition filed under Article 227 of Constitution of India to set aside the order dated 13.02.2017 passed in I.D.O.P.SR.No.11512 of 2016 by the Principal Judge, Family Court, Chennai.

ORDER
Challenging the docket order passed by the Principal Judge, Family Court, Chennai in I.D.O.P.SR.No.11512 of 2016, the petitioner, who is the husband of the respondent, has filed the above Civil Revision Petition.
2. The Original Petition in I.D.O.P.SR.No.11512 of 2016 was filed by the petitioner for divorce, on the ground of nullity. The Family Court, Chennai returned the application, raising a query with regard to the territorial jurisdiction of the matter.
3. By order dated 13.02.2017, the Family Court, Chennai returned the papers for representing the same before the Competent court, which has got jurisdiction. In the order, it has been stated that the order was passed after hearing the petitioner.
4. However, the learned counsel appearing for the petitioner has stated that the petitioner has not made his submissions before the Family Court, Chennai with regard to the maintainability of the Original Petition.
5. In view of the submissions made by the learned counsel for the petitioner, in order to give one more opportunity to the petitioner, in the interest of justice, the petitioner is given liberty to make his submissions with regard to the maintainability of the Original Petition before the Principal Judge, Family Court, Chennai within a period of one week from the date of receipt of copy of this order.
6. The Principal Judge, Family Court, Chennai is directed to consider the submissions to be made by the learned counsel for the petitioner and decide the issues with regard to the maintainability of the Original Petition and pass suitable orders.
7. With these observations, the Civil Revision Petition is disposed of. No costs.

(ii) The Registry is directed to return the Original Petition in I.D.O.P.SR.No.11512 of 2016 filed by the petitioner in this Civil Revision Petition to the learned counsel of the petitioner.
