JUDGMENT / ORDER

The limited prayer in this original petition filed under Article 227 of Constitution of India is for a direction to the Munsiff Court, Pathanamthitta to take up and dispose of I.A.No. 1770/2012 in O.S.No. 84/2003.
2. The petitioner before this Court is the plaintiff in the suit. It so happened that the suit was dismissed for default. Within the time stipulated, he filed a restoration application as I.A.No.1770/2012. The complaint of the plaintiff is that under one pretext or another, the case is being adjourned and the matter is not being heard, causing irreparable loss and injury to the petitioner. The petitioner therefore prays for a direction for speedy disposal of that petition.
3. In the light of the order that is proposed to be passed, it is felt that notice to the respondent is unnecessary.
O.P.(C) No.2484 of 2014 -2-
This petition is allowed and there will be a direction to the Munsiff Court, Pathanamthitta to take up I.A. No. 1770/2012 in O.S.No. 84/2003 and dispose it of in accordance with law, after hearing all the parties, provided, it is ripe for hearing, within a period of one month from the date of receipt of copy of this judgment.
