K. Gowthaman vs 2 The Director Of School Education

Madras High Court|05 April, 2017

JUDGMENT / ORDER

Mr. T.M. Pappiah, learned Special Government Pleader, accepts notice for the respondents. With consent, this writ petition is taken up for final disposal at the admission stage itself.
2 The petitioner was appointed as P.G. Assistant (Physics) in the Government Higher Secondary School, Morappur, Dharmapuri District on 15.09.1997 and after he completed his probationary period, his service was regularised on 09.11.1999. Thereafter, on the basis of his seniority, he was promoted as Headmaster and appointed in the Government Higher Secondary School, R.S. Mangalam, Ramanathapuram District on 19.12.2015. As he is a resident of Dharmapuri District, finding it very difficult to maintain his family and his old father, he has addressed a representation dated 31.08.2016 to the second respondent requesting to transfer him from Ramanathapuram to Dharmapuri District. Since no orders have been passed on the said representation, he has preferred the instant writ petition seeking a writ of mandamus directing the respondents to give priority to his case before the counselling for the academic year 2017-2018 and transfer him from Government Boys Higher Secondary School, R.S.Mangalam, Ramanathapuram District, to any Government Higher Secondary School at Dharmapuri District as Headmaster, based on his representation dated 31.08.2016, forthwith.
3 Since the petitioner was all along working in Dharmapuri District as P.G. Assistant and only after promotion to the post of Headmaster, he has been transferred to Ramanathapuram District, he has given the aforestated representation to consider his case for transfer back to his native district.
4 In view of the above factual matrix and considering the limited scope of the relief sought by the petitioner, this Court directs the second respondent to consider and pass orders on the petitioner's representation dated 31.08.2016, on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition stands disposed of. Costs made easy. Connected W.M.P. is closed.
