ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, declaring the action of the respondents in seeking to replace the petitioners from the posts of Special Officer, KGBV by other contract employees as illegal, arbitrary and contrary to Section 82 of the Andhra Pradesh Reorganization Act, 2014 as also contrary to G.O.Rt.No.2147 General Administration (DPC.1) Department, dated 16.05.2014.
Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondents.
The petitioners are retired Government employees. After their retirement, they were engaged on contract basis as Special Officers in Kasturba Gandhi Balika Vidyalayas in various Mandals of Guntur District. They filed the present writ petition seeking a direction not to discontinue them. The Government issued G.O.Ms.No.84, dated 17.04.2014 enabling continuation of the contract employees till the end of June of the concerned year.
It is agreed by both the learned counsel appearing for the parties that the issue raised in this writ petition is squarely covered by Judgment dated 14.07.2014 passed by the Division Bench of this Court in W.A.No.1028 of 2014.
Matter involving identical facts fell for consideration before the Division Bench of this Court in W.A.No.1028/2014. The learned Division Bench took the view that the petitioners therein were purely engaged on contract basis and they do not have even a semblance of right to continue beyond the period mentioned in the contracts.
In view of the above, this writ petition is dismissed in terms of the said judgment with the direction that the observations contained therein shall be read as part of this order. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
