Arabatti, Standing Counsel) This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C praying to set aside the order dated 02.06.2015 in Special Case No.17/2013 passed by the Principal Sessions Judge and Special Judge, Bengaluru Rural District, Bengaluru, which is at Annexure-D and allow the application filed by the petitioner under Section 227 of the Code of Criminal Procedure i.e., Annexure-C and etc.
This Criminal Revision Petition coming on for Admission this day, the Court made the following:-
O R D E R After hearing the learned counsel for the petitioner and the learned Standing counsel for the respondent on the issue, the scope of the revision is very less. It is submitted that already the evidence has been commenced and the parties are leading the evidence. Under such circumstances, without expressing anything on merits of the matter, I feel that if the discretion is left to the trial Court to consider of the aspects which have been raised in this petition and the petition is disposed of, it would meet the ends of justice.
In that light, petition is disposed of with the aforesaid observations.
In view of disposal of the petition, I.A.No.1/2015 is dismissed as it does not survive for consideration.
