This writ petition is filed for a mandamus declaring the action of the 2nd respondent in not passing any orders on the stay application filed along with the appeal on 30-08-2014 as illegal and arbitrary and for a consequential direction to the 2nd respondent to dispose of the appeal.
2. The case of the petitioner is that he was appointed as fair price shop dealer of Shop No.43, N. Racherla village, Peapally Mandal, Kurnool District about 10 years back and since the date of appointment he has been distributing the essential commodities to the cardholders without any complaint. While so, basing on the report of the 4th respondent-the Tahsildar, Peapully Mandal dated 08-07-2014 stating that the petitioner committed certain irregularities, the 3rd respondent issued proceedings in Rc.B/731/2014, dated 23-08-2014 suspending the authorisation of the petitioner. Challenging the said proceedings, the petitioner preferred an appeal before the 2nd respondent along with the stay application and the same is pending consideration. But, the 2nd respondent has not passed any orders thereon. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Since it is stated that a statutory appeal is filed by the petitioner before the 2nd respondent, which is pending before him, the 2nd respondent is directed to dispose of the appeal, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of the order.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
