The orders passed under A.P. Assigned Lands (Prohibition of Transfer) Act, 1977 (for short ‘the Act’) are assailed in this writ petition.
Admittedly, petitioner-company has purchased the land covered by R.S.Nos.687, 688, 368 and 376 in Lakshmipuram Village, Challapalli Mandal, Krishna District. Later on, it has come to its notice that the purchase of said land attracted the consequences of purchase under the Act. The authorities have passed orders cancelling the assignment and taken steps to resume the said land. Hence, the writ petition.
Heard the learned senior counsel appearing for the petitioner and learned Government Pleader for respondents.
Learned senior counsel submits that the subject matter of the land is very much required for the petitioner-company and the petitioner may be given liberty to approach the 1st respondent-
Government by way of representation to assign/grant the petition land on payment of consideration since the petitioner, at the present location, is carrying Bio Compost Manure activity and it is useful to ryots in and around the village.
Having regard to the reasonable prayer made in this behalf, the writ petition is disposed of as follows.
Liberty is granted to the petitioners to approach the 1st respondent-Government by way of representation to grant/assign at market rate within a period of four weeks from today and the representations shall be disposed of within a period of three months thereafter. Till disposal of the representation filed by the petitioner, status quo granted earlier shall continue.
With the above observation, the writ petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
