… PETITIONER … RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENTS TO CONSIDER THE REPRESENTATION OF PETITIONER VIDE ANNEX-C FOR WAIVER OFFF INTEREST AND PENAL INTEREST AND PERMIT HIM TO REPAY ONLY THE PRINCIPAL LOAN AMOUNT FORTHWITH AND ETC.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER None for the petitioner.
Mr.T.P.Muthanna, learned counsel for respondent Nos.1 and 2.
2. In this petition, the petitioner inter alia seeks for a direction to the respondents to consider his representation contained in Annexure-C for waiver off interest and penal interest and permit him to pay the principal loan amount.
3. When the matter was taken up today, learned counsel for the respondents submitted that the representation submitted by the petitioner shall be dealt by the competent authority in accordance with the guidelines issued by the Reserve Bank of India.
4. In view of the submission made and in the facts of the case, the writ petition is disposed of with a direction to the competent authority of respondent-Bank to consider the representation submitted by the petitioner for waiver of interest in accordance with the guidelines issued by the Reserve Bank of India by a speaking order within six weeks from the date of receipt of certified copy of the order passed today.
It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
