THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18971 of 2014 ORDER :
The petitioner claims to have paid sale consideration to his vendor to purchase Ac.0.11 cents of land in Survey No.17/5 situated at Avilala Village, Tirupati Rural Mandal. When he intend to present the deed of conveyance, the Sub-Registrar refused to entertain the same on the ground that the said land is in the prohibited list of properties as per the letter of Commissioner of Endowments, dated 19.04.2010.
2. Apparently, no deed of conveyance is presented before the Sub-Registrar and the petitioner made a vague statement that the Sub-Registrar refused to register the same. The claim that the Sub-Registrar was not entertaining the deed of conveyance does not arise and there is no subsisting grievance of the petitioner.
3. Hence, this Writ Petition is disposed of granting liberty to the petitioner to present the deed of conveyance before the Sub-Registrar. As and when such deed of conveyance is presented, the Sub-Registrar shall receive and process the same in accordance with Registration Act, 1908 and the Indian Stamp Act, 1899. If the Sub- Registrar has valid reasons for refusing to register the deed of conveyance, he shall pass orders under Section 71 of the Registration Act and communicate the same to the petitioner within a period of two weeks from the date of receipt of said application. No costs.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
