ORDER:
This Writ Petition is filed to declare the action of the respondents in not supplying the essential commodities to the petitioner’s fair price shop as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Civil supplies has submitted that the petitioner was appointed as a temporary dealer in the place of the permanent dealer whose authorization was suspended pending disciplinary enquiry. He has placed before the court the proceedings of respondent No.3 in Ref.B.624/2004, dated 26-12-2014 and submitted that the authorization of the permanent dealer of the fair price shop in question has been restored and stocks have been released by imposing a fine of Rs.5000/-.
In view of the above noted submissions of the learned Assistant Government Pleader, the cause in the Writ Petition does not survive for adjudication and the same is accordingly dismissed as infructuous. As a to the dismissal of the Writ Petition, WPMP No.50101 of 2014 filed for interim relief is dismissed as infructuous.
