Heard learned counsel for the parties.
The petitioner’s request for conducting survey under his application dated 3.7.2013 was rejected by the third respondent under the impugned endorsement dated 14.8.2013 on the ground that ‘TIPPANS NOT AVAILABLE’. Such a ground is not tenable, as it is for the third respondent to obtain survey record from the Director of Survey and Land Records and conduct survey in terms of the records. Therefore, the impugned order cannot be sustained.
Hence the writ petition is disposed of directing the third respondent to consider the application of the petitioner for conducting of survey and pass appropriate orders in accordance with law by or before 30.6.2014 after notice to all the affected parties. Miscellaneous applications, if any, shall stand closed. No costs.
