Venkata Ramana, learned Senior Advocate, appears for the appellants, and Sri P. Venugopal, learned Advocate and learned Advocate General of the State of Andhra Pradesh, appears for the respondent – writ petitioner.
This appeal is sought to be preferred against the interim order dt.25.6.2014.
After deliberation for sometime in Court, Sri P. Venugopal, learned Advocate, appearing for the respondent – writ petitioner upon instructions submits that the order passed by the Hon’ble single Judge may be overlooked and set aside. However, this Court may pass appropriate order so that justice is rendered to his client. He also submits on instructions that he will withdraw the writ petition as his client does not want to proceed with the same.
We record the submission of the learned counsel for the respondent – writ petitioner and we give liberty to his client to approach the Hon’ble single Judge for formal decision of withdrawal of the writ petition. We hope and trust that the Hon’ble single Judge taking note of this order as well as submission will obviously pass appropriate orders.
The order of the Hon’ble single Judge, as agreed to by the respondent – writ petitioner, is hereby set aside. However, taking note of the records placed before us, we expect that the officer in-charge of the local police station will take steps in accordance with law pursuant to the first information report lodged already, at an early date. All points are kept open both for investigation, and for adjudication by the learned Civil Judge.
The writ appeal is accordingly disposed of. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall stand closed.
