Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ of mandamus to set aside the orders of Hon'ble Andhra Pradesh Administrative Tribunal passed in OA No. 6736 of 2013 dated 13.09.2013 after declaring the same as illegal, arbitrary, against the principles of Natural Justice, Contrary to the A.P. Police Subordinate Service Rules framed under G.O.Ms. No. 1263 GA(Rules)Department dated 26.09.1959 and A.P.State and Subordinate Service Rules , and consequently set aside the consequential orders passed by the 1st respondent in Rc No. 161/A1/Cyb/2013 dated 28.09.2013 regularizing the 5th respondent from the date of his promotion as Head Constable on out of service basis and proceedings vide Rc No A1/161/PPT/CYB/2013 dated 15.10.2013 directing the 5th respondent to undergo Pre Promotional Training for the post of Sub Inspector.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court order dated 31-10-2013 made in WPMP. No. 38248 of 2013 and upon hearing the arguments of Smt G. Jyoti Kiran, Advocate for the Petitioners and of GP for Home for the Respondent No. 1 to 5 and of Sri C . Nageshwar Rao, Advocate for the Respondents No. 7 to 83, the Court made the following.
ORDER:
“With the consent of the parties, the earlier order, dated 31.10-2013, is modified as follows;
Admittedly, there are 244 Sub Inspector (Civil) vacancies available for Rank promote quota. The dispute in the writ petitions is with regard to regular promotions basing on the seniority and also out of turn promotion for the candidates who did meritorious services.
In view of the fact that the vacancies are more and the eligible candidates in both the categories are less, there is no impediment for giving promotions to the Head Constables/Assistant Sub Inspector of Police, who are eligible to be promoted as Sub Inspector (Civil ) in the existing vacancies.
Therefore, the Government is at liberty to fill up the Sub Inspector (Civil) vacancies basing on the eligibility in the category of Head Constables and Assistant Sub Inspector for promotion to the post of Sub Inspector (Civil). The promotions which may be given in pursuance of this interim order is subject to the result of the writ petition with regard to determination of the seniority.”
