…Petitioner State of Telangana, rep.by its Principal Secretary, Medical Education, at Secretariat, Hyderabad and others …Respondents Counsel for the petitioner: Sri R.Gopala Krishna Counsel for respondent No.1: AGP for Medical, Health & Family Welfare Counsel for respondent No.2: Sri M.V.S.Prasad Counsel for respondent Nos.3 & 4: Sri A.Prabhakar Rao The Court made the following:
ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent Nos.2 & 3 in not receiving sports certificates submitted by petitioner herein inspite of orders passed by this Hon’ble Court on 26.09.2014 in WPMP No.37014 of 2014 in WP No.29635 of 2014, as illegal, arbitrary and unconstitutional and to consequently direct Respondent Nos.2 & 3 to forthwith receive the sports certificates submitted by petitioner herein and assign priority accordingly after sending the same to 5th Respondent for verification and authentication, for the purpose of securing admission by petitioner in MBBS/BDS Course into 3rd Respondent University under sports quota for the academic year 2014-15; Award costs.”
At the hearing, it is not disputed that the entire admission process into the MBBS and BDS Courses has been completed and classes have already been commenced long back.
In view of the same, the relief claimed in this writ petition cannot be granted. However, this order will not preclude the petitioner from availing appropriate remedy for damages against such of those respondents who according to the petitioner are responsible for allegedly denying her the valuable seat.
Subject to the liberty given as above, the writ petition is dismissed.
As a sequel to dismissal of the writ petition, W.P.M.P.No.37298 of 2014 shall stand disposed of as infructuous.
