1. Learned advocate for the petitioner has relied on the order passed by the Division Bench in Letters Patent Appeal No.214 of 2011 and other appeals. She submitted that the said appeal was preferred by present respondent no.1. Differently put according to the submissions of learned advocate for the petitioner, the concerned respondent in present petition was party to the proceedings as appellant in the Letters Patent Appeal No.214 of 2011. She submitted that the direction passed by the Division Bench in the said appeal are passed against present respondent no.1, however, respondent no.1 is not complying said direction so far as present petition is concerned, though the petitioner is similarly situated as the persons concerned in the said group of appeals.
