Heard learned counsel for the parties.
The transfer application is by the wife and seeks transfer of a petition under Section 11 of the Hindu Marriage Act filed by the husband at Aligarh. Its transfer is being sought to District Bulandshahr on the ground of convenience and also on the ground of pendency of other cases between the parties at Bulandshahr.
Counsel appearing for the opposite party has on the basis of averments made in the counter affidavit submitted that the matter be not transferred to Bulandshahr but may be transferred to some other adjoining district.
The averments made in the counter affidavit have not been controverted as no rejoinder affidavit has been filed.
However, looking into the totality of circumstances, the transfer application, is hereby allowed. Case No. 1039 of 2018 (Munesh Kumar Vs. Smt. Jyoti) pending before the Principal Judge, Family Court, Aligarh shall stand transferred to District Khurja, forthwith.
