Heard learned counsel for the parties.
Petitioner is the wife of Ex-Medical Officer, who died in harness on 8 August 2014. By the instant writ petition, petitioner seeks following relief:
i) issue a writ, order or direction in the nature of mandamus directing the respondent authorities to consider the case of the petitioner for her appointment on the post of Junior Clerk at District Hospital Agra/Mathura on the compassionate ground under the Dying in Harness Rules.
Learned Standing Counsel submits that the second respondent-Director General, Health & Family Welfare, Lucknow, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the second respondent-Director General, Health & Family Welfare, Lucknow, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
