Supplementary affidavit filed in compliance of order dated 26.11.2018 is taken on record.
The petitioner by means of instant petition has made a prayer for issuance of a direction to the Prescribed Authority before whom P.A, Case No. 4/2016 under Section 21(1)(a) of U.P. Act No. 13 of 1972 is pending to decide the same within a stipulated time. It is pointed out that the mediation between the parties has failed and now matter is being posted for decision by the Prescribed Authority. The release application was filed two years back, but it has not been decided so far, whereas, Rule 15 of the Rules framed under the Act provides for application being decided within two months from the date of its presentation.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of by directing the Prescribed Authority to make all endeavour to decide the release application expeditiously, without granting unnecessary adjournments, preferably within a period of six months from the date of production of certified copy of this order.
