Heard Sri Prabhakar Singh, learned counsel for the petitioner. Sri F.A. Ansari, has appeared for the U.P. Public Service Commission.
The petitioner is B.D.S. and is working as Dental Surgeon in the Community Health Centre at Varanasi.
He is aggrieved by the advertisement dated 30.12.2017 issued by the U.P. Public Service Commission inviting applications for 596 posts of Dental Surgeon.
The submission of the learned counsel for the petitioner is that since the petitioner is already working as Dental Surgeon on contract basis, he is entitled to weightage and therefore, the advertisement may be modified accordingly.
The submission is wholly devoid of any merit, inasmuch as, there is no provision for granting any wightage to any person who may be working earlier. Apart from this, if the petitioner has gained experience by working, he is likely to do well in the selection and as such he cannot have any grievance in this regard. The matter of laying down conditions and procedure of selection is solely upon the State Government and the Commission for which no intervention of the judicial process is warranted.
In view of the facts and circumstances, we find no merit in the petition and the same is dismissed.
