THIS PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent- State.
The petitioner/accused is charge sheeted by the respondent-Police in their Crime No.171/2016 for the offence punishable under Section 307 of IPC for attempting to cause the murder of none other than her own child Abhilasha aged 14 years.
2. The allegation of the prosecution is, C.W.2 is a mentally retarded child of the petitioner herein; she was fed up in taking care of him and determined to finish him off. On 11.9.2016 she laid him in a ditch and tried to cover him with pebbles, which caused simple injuries to the victim. However, the complainant rescued the child.
3. As per the submission at the Bar, now the child is under the care of its grand mother.
4. The accused being a lady of known identity and investigation since complete, there is no impediment to enlarge the petitioner on bail.
5. Accordingly, petition is allowed. Petitioner is enlarged on bail in Crime No.171/2016 registered by the respondent- Police, subject to following conditions:
(i) She shall execute a self bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) She shall attend the Court regularly on all hearing dates.
