1. The petitioner is conducting service on the route Pathanamthitta- Chavara on the strength of a temporary permit issued to the stage carriage bearing registration No.KL-26/B 4555. The permit is valid till 1.12.2014. The same was issued in place of stage carriage bearing Reg.No.KL-17/D 887. The petitioner has approached this Court with a prayer to direct the respondent to issue temporary permit of four months' duration to the petitioner's stage carriage No.KL-17/D 887 on the route Pathanamthitta-Chavara.

If vacancy of stage carriage bearing registration No.KL-17/D 887 is still in existence and no other person having a better claim has applied for the same, there will be a direction to the respondent to issue a temporary permit of four months duration within a week from the date of production of a copy of this judgment by passing W.P.(C)No.33994 of 2014 -:2:-
appropriate orders on Ext.P5, if there is no legal impediment. Needless to say, such issuance of temporary permit will be subject to any preferential claim.
Writ petition is disposed of as above.
