1. Both the advocates have received instructions from their respective clients and representative of the company- employer Mr. Rajesh Palkar, General Manager, H.R. Division is present in the Court. Under their instructions, it is requested by learned advocates for the parties that in the interest of justice let there be a modification in the award under which only 25% backwages are granted. So instead of 25 % backwages there should be 50% backwages.
2. Accordingly, with the consent of learned advocates for the parties the award impugned is modified. Now it shall read instead of 25 % backwages, it should be 50% backwages. Other directions contained in the award & order dated 3/12/2001 at Exhibit-37 in Reference (LCV) 841 of 1986, passed by the Labour Court, Vadodara will remain as it is.
3. In view of above direction, this petition is disposed of. Rule made absolute to the aforesaid extent. No order as to costs.
