Heard learned counsel for the parties.
It is submitted that this writ petition is similar to W.P.No.8513 of 2014 disposed on 21.03.2014.
In this writ petition also the Tahsildar-3rd respondent passed orders dated 27.1.2014 against the petitioners alleging violation of Section 3 of A.P. Assigned Lands (Prohibition and Transfer) Act, 1977. The petitioners state that against the said orders, they have preferred an appeal before the second respondent on 11.4.2014 along with an application for stay, but no orders having been passed, the present writ petition is filed.
In view of the facts and circumstances of the case, if the petitioners are evicted pending the appeal, the appeal itself would become infructuous. Therefore, I deem it appropriate to dispose of this writ petition directing the second respondent to consider the petitioners’ appeal along with the stay petition and pass appropriate orders, either interim or final, within four weeks from the date of receipt of a copy of this order and till then, the order of 3rd respondent, impugned in the said appeal, shall not be given effect to.
The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
