(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 85 days in preferring the appeal against the judgement and order passed by the learned Sessions Judge in Sessions Case No.4 of 2006.
We have heard Mr.Vatsa, learned Counsel for the applicant, Mr.Panchal, learned Special Public Prosecutor for the State and Mr.Barot, learned Counsel for respondents No.2 to 5.
Considering the facts and circumstances and in view the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned and, therefore, condoned.
The application is allowed to the aforesaid extent. Rule made absolute accordingly.
