JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred for leave to prefer appeal against the judgement and order passed by the learned Sessions Judge in Sessions Case No.4/2006, whereby certain respondents have been acquitted for the offence punishable under Section 302 of IPC.
Mr.Panchal, learned Special Public Prosecutor for the State, on instructions, has declared before the Court that the State has not preferred any appeal against the acquittal for the offence punishable under Section 302 of IPC.
The present appeal is preferred by the victim and injured eye-witness.
Considering the facts and circumstances, leave deserves to be granted and, therefore, granted. The application is disposed of accordingly.
