When the matters were called out Mr. Hemant Makwana for Mr. Kanara for respondent no.1 is present. Learned AGP Ms. Raval has received instructions from Dy. S.P. Mr. G.R. Gadhvi of Jamnagar District and submitted that the petitioners as on date are not named as required persons in respect of any pending investigation, nor they are named as accused in any of the complaints registered. One relative Kasam Abu Bokal is accused of smuggling activities and his passport is seized under the Court's order. On account of close relation of said Kasam Abu Bokal, under suspicion, it was thought fit by local police officers to be vigilant and keep watch over the activities of certain citizens, petitioners happened to be some of them. Therefore in past, in the year 2009 negative opinion was expressed. The request from the Passport office for second opinion or further opinion if received would be responded appropriately and expediently, and if there is need be appropriate guidance will also be obtained from the concerned.
At this stage, unfortunately, it is not clear as to when the second opinion report or second police verification report is called for. In light of this, let there be a clarity in respect of the dispatching date under which it is ascertained by Passport office that second police verification was required. The respondent no.1 shall put it on affidavit with documentary evidence in form of copies to indicate as to when the second report was called for, and whether it has received any acknowledgment due card, indicating that it has reached the addressee.
The respondent no.2 shall also on affidavit state as to whether that office has received the document, namely request for second police verification from Passport office, and if it has not received, then, affidavit to that effect also be placed on record.
