Learned advocate for the applicant contends that the applicant is not a person named in the chargesheet filed after the investigation and it is the case of the applicant that in view of his date of birth 31.12.1982 which is recorded in School Leaving Certificate viz-a-viz the date of offence dated 11.12.2000 as mentioned in the F.I.R. and the chargesheet, even if the applicant is the accused named so in the F.I.R. and the chargesheet, he is entitled for the benefits of provisions of Juvenile Justice Act, 2000, amended in the year 2006 and insertion of Rules in the year 2007 as well as the judgment of the Supreme Court in the case of Hari Ram V/s. State of Rajasthan reported in (2009)13 SCC 211.
