Junagadh vs State

High Court Of Gujarat|21 February, 2012

JUDGMENT / ORDER

It is clarified by the concerned learned advocates that in view of the order passed in main petition i.e. Special Civil Application No.5573 of 2011, the above said two civil applications i.e. Civil Application No.10354 of 2011 and Civil Application No.11874 of 2011 would not and do not survive and the same can be accordingly disposed of.
Furthermore, learned AGP Ms. Pathak has today submitted that the Government has appointed the liquidator, as was initially being considered by the Government.
Thus, now even the said action has also been taken by the Government and therefore also the purpose of said applications do not survive.
Hence, in view of the above mentioned clarifications by the learned advocates, the said two civil applications i.e. Civil Application No.10354 of 2011 and Civil Application No.11874 of 2011 are disposed of in view of the order passed in Special Civil Application No.5573 of 2011. It is clarified that the said two Civil Applications are not dismissed on merits, but are merely disposed off as they haver lost their purpose at this stage, as per the clarification by learned advocates, in view of the order in main petition.
