The petitioner, who is defendant in Original Suit No. 316/2007 has filed the instant petition seeking a direction to the trial Court to decide the suit expeditiously, within a time specified by this Court.
Counsel for the petitioner submitted that the suit is pending since the year 2007, and certain issues have already been decided, as preliminary issues.
A perusal of the order sheet reveals that at present the Court is lying vacant. In such view of the matter, this Court is not inclined to issue any direction, as prayed for in the instant petition, but leaves it open to the petitioner to seek transfer of the proceedings by moving appropriate application under Section 24 CPC before the District Judge or pray for expeditious disposal of the proceedings, soon after a Presiding Officer is posted in the Court, where the matter is pending.
The petition is disposed of accordingly.
