JUDGMENT / ORDER

Heard learned counsel for the petitioners. The grievance of the petitioner is that an application moved at the behest of respondent under section 156 (3) Cr.P.C. was treated as complaint and after recording statements under section 200 and 202 Cr.P.C., the petitioners have been summoned under sections 147, 323, 504, 506 I.P.C. and 3(1) (X) S.C./S.T.Act.
Issue notice to the O.P.No.-2 returnable at an early date. Learned A.G.A. accepted notice on behalf of respondent No.-1. Respondent No.-2 may file counter affidavit within period of three weeks from the date of receipt of notice. Learned A.G.A. may also file counter affidavit within four weeks. Rejoinder affidavit may be filed within three weeks thereafter.
List this case after expiry of the aforesaid period.
Till the next date of listing, operation of the impugned order dated 15.12.2009 passed by Incharge Sesions Judge, Jhansi in Criminal Revison No. 91 of 2009 and order dated 17.11.2009 passed by Judicial Magistrate Garotha, Jhansi in Criminal Complaint Case No. 2379 of 2006 under section s147, 323, 504, 506 I.P.C. and 3(1) (X) S.C./S.T.Act. shall remain stayed.
