Heard Sri Bhuvnesh Kumar Singh, learned counsel for petitioner and learned Standing Counsel for respondent No. 1 and Smt. Sudha Pandey, learned counsel for respondent Nos. 2 and 3.
The petitioner in the writ petition states that he is willing to deposit the entire loan amount of Rs.8,20,972.75/- in easy instalments.
In our view, it is not the business of the High Court to fix instalments as it is a contractual matter between the petitioner and the bank concerned. The petitioner should approach the bank itself and get the instalments fixed to the satisfaction of the parties.
The writ petition is, accordingly, dismissed with liberty to the petitioner to apply before the respondent No.3- Punjab National Bank within one week from today in respect of the relief as claimed in the writ petition. In the event such application is made by the petitioner, the respondent No.3- Punjab National Bank shall pass appropriate order thereon within a period of one month thereafter.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
