(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Pursuant to the notice issued herein, the Police Inspector, Mr. C.L. Solanki of Ramol Police Station, brought and produced the corpus in the Court. Upon being asked, she has stated that she was beaten out of her matrimonial home, and she does not want to either return or talk to the petitioner on account of having been subjected to such cruelty. She also stated that their children are in custody of the petitioner by her consent, and she only wants to return to the place of her parents.
It appears from the above statement that the petitioner has unnecessarily moved the High Court on the basis of incorrect averments and consciously suppressed the real facts. Therefore, the petition is dismissed with costs quantified at Rs.3000/- (Rupees Three Thousand only), which shall be paid by the petitioner to respondent no.3, by money order as stated by learned counsel Mr. Raval on instruction of the petitioner. Learned counsel Mr. Raval is directed to produce the evidence of remittance of the amount of costs to respondent no.3 latest by 06.03.2012 in the office of the High Court, and if such evidence is not produced, the matter may be listed before this Court for further orders.
