This revision has been directed against the order passed in E.P.No.3351 of 2007 in O.S. 6846 of 2001 on the file of IX Assistant Judge, City Civil Court, Chennai which was filed under Order 21 Rules 43 and 64 of CPC.
2. According to the decree holder, the Judgment Debtor/revision petitioner herein owes a sum of Rs.2,79,487/- inclusive of cost and interest. According to the revision petitioner, on 7.4.2006, the Judgment Debtor had paid a sum of Rs.1,50,000/- and subsequently also, has paid Rs.25,000/- towards the decree amount and as per the orders of this Court in M.P.No.1 of 2008 in C.R.P.(NPD)No.2751 of 2008 dated 18.8.2008, had also paid a sum of Rs.1,00,000/- towards the E.P. amount and further undertakes to pay the entire balance of amount in the E.P.if a reasonable time is given.
3. In fine, this civil revision petition is admitted and three weeks time is granted for the revision petitioner from today ie. On or before 8.4.2009 for payment of balance of E.P.amount, failing which this civil revision petition shall deem to have been dismissed.With the above observation, this civil revision petition is disposed of. No costs. Consequently, connected M.P.No.1 of 2008 is closed.
