JUDGMENT / ORDER

The proceedings challenged in this writ petition is only a notice calling upon the petitioner to appear for an enquiry in an appeal filed before the District Revenue Officer arising out of patta proceedings and against the order passed by the Revenue Divisional Officer.
2. Though the learned counsel appearing for the petitioner submitted that a civil suit is pending and therefore, this appeal cannot be heard by the District Revenue Officer, I am of the view that all these contentions can be raised by the petitioner before the official, who issued the notice, without resorting to filing of this writ petition. Since what is impugned in this writ petition is only a notice, which in my considered view, need not be interfered with, as it is always open for the petitioner to appear before the first respondent and place all his submission. Granting such liberty, this writ petition is disposed of accordingly without expressing any view on the merits of the claim made by the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
