This matter has been listed before this court time and again. Matter has been listed on 09.01.2012, 19.01.2012, 31.01.2012, 16.02.2012 and finally today. On all the occasions Mr. Desai, learned advocate for the appellant has filed sick note. Even today, sick note has been filed by Mr. Desai. Appeal is of the year 2005 wherein claim petition of the year 1997 is challenged. Therefore, in the interest of justice as a last chance matter is adjourned to 01.03.2012. It is clarified that on the next date if Mr. Desai is not in a position to appear, he shall make alternate arrangement failing which appropriate orders shall be passed exparte.
